Business Plan Legal Requirements

What are my requirements for beginning a tutoring business?
I am starting a small tutoring business. I wanted to know what is required of me to get started. Should I hire employees or independent contractors? If independent contractors, what must I do or not do to make sure I am doing things correctly and don’t get in trouble or sued? Do I need a business plan or a business license? I want to make sure that everything is legal. Thank you.
A few points:
1) Look at the business rules of other businesses in your market. What are they doing? What are they not doing?
2) Get a copy of your areas Employee Guide / Labor Standards. Read it. When you’ve finished reading it. Read it again.
3) Going into business without a business plan is financial suicide. You might as well just throw your money out the window. People tend to go into business because someone has told them that they “are good at it”. Even if it’s an ‘informal business’ having some ranges will be good.
4) What sort of credentials do you have? Customers are going to look at what you have to offer. Then you can expect the same from your employees/staff. Look at what sort of educational or instructor courses are out there that people have used to improve skills (i.e. adult learning techniques, Instructional Methodology, The true difference between education and tutoring, etc.)
5) If you hire contractors then you need to have a legal doc that will legally stand on its own. Otherwise they could sign it and it’s not worth the ink they used.
5) Yes – you should have a business license if you’re operating a business. That’s the law. Unless this is going to be more of a part time thing. If you’re just doing it on the side for say a small amount in cash then the gov’t won’t care. I’d research this because if you’re doing it out of home then the municipal office may conduct inspections on the premises. It’s not scary, it’s just municipal procedure to ensure everything is safe. I’d get a list from city hall from the Inspections or Bylaws dept as to what they look for. They’re not out to fail you. Also there is the tax man to consider…
Other questions:
- How are you tracking your accounting? In case you get auditted?
- What are you looking for in an employee? Experience?
- What is your demographic or target market? i.e. Geographical radius, Age target,
- What are you tutoring? Math? English? other? What are your specialties?
- Website: What is the look? How can people contact you?
- What is your financial plan for expenditures? Rent? Phone? Expenses? Materials?
- What makes your business different than other tutoring services?
I don’t ask all these to intimidate you..more so to better prepare you for all the questions and concerns you may get.
